- 満坤第四三六○号 俘虜刑罰ニ関スル件 請議案 陸海軍治罪法中俘虜降人ノ犯罪ヲ軍法会議ニ於テ審判スルノ規定アルモ刑法及陸海軍刑麗中俘虜ノ行為トシテ特ニ之ヲ処罰スルノ規定ナシ故ニ俘虜ヲ軍法会議ニ於テ審判スルハ其ノ刑法ノ罪ヲ犯シ又ハ陸海軍刑法中何人ヲ問ハス適用スヘキノ条項ニ触レタル場合然ルニ俘虜ノ行為トシテ反抗又ハ共謀ノ逃走ヲ為スカ如キ宣誓ニ背クツ為器ヲ操ルカ如キ特ニ之ヲ処罰スルノ規定ナキハ欠点ト云ハサルヲ得ス是レ目下ノ状態ニ於テ本令ノ発布ヲ必要トスル所以ナリ勅令案ヲ添ヘ閣議ヲ請フ 年月日 海軍大臣 陸軍大臣 司法大臣 満発第四四○五号 勅令案 朕茲ニ緊急ノ必要アリト認メ枢密顧問ノ諮詢ヲ経テ帝国憲法第八条ニ依リ俘虜ノ処罰ニ関スル件ヲ裁可シ之ヲ公布セシム
