- 第三章 開戦当時帝国港湾ニ在泊スル露国船舶拿捕免除ニ関スル件 明治三十七年一月中旬ニ至リ、日露両国ノ関係益々切迫ヲ告ケ、何時其ノ破裂ヲ見ルヤモ計ラレサルモノアルニ至レリ、然ルニ当時ニ於テハ日露両国間ノ交通頗ル頻繁ニシテ、我カ国ニ来往スル露国商船亦尠シトセス、而テ近代ノ国際慣行ニ依レハ、開戦当時敵国商船ニ対シテ、一定シテ恩恵期間ヲ与フルハ其ノ常規トスル所ナルヲ以テ、山本海軍大臣ハ露国ノ態度如何ニ関セス、我カ国ニ於テハ飽クマテ公正ノ手段ニ出ツルヲ得策ナリトシ、開戦当時帝国港湾内ニ在泊スル露国商船拿捕免除ニ関スル勅令案、並ニ露国義勇艦隊所属船舶、及ヒ官用船舶ノ捕獲ニ関スル閣令案ヲ具シ、戦時ニ移ルト同時ニ
